1. Acceptance of Terms

By accessing or using the TikSend platform — including our website, mobile applications, and all associated services — you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, please do not use our Service.

TikSend reserves the right to modify these terms at any time. Continued use of the Service after modifications constitutes acceptance of the revised terms.

2. Description of Service

TikSend is a technology platform that connects individuals and businesses ("Senders") with independent bike riders ("Riders") for same-day package delivery services. TikSend acts as an intermediary platform and is not itself a logistics provider or delivery company.

TikSend does not guarantee the availability of riders at any specific time or location. Delivery times are estimates and are subject to traffic, weather, and other conditions beyond our control.

3. User Accounts

To use TikSend, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  • You must be at least 18 years old to create an account
  • Each person may hold only one account
  • You must notify us immediately if you suspect unauthorised use of your account
  • TikSend reserves the right to suspend or terminate accounts that violate these terms

4. Sender Responsibilities

As a Sender, you agree to:

  • Provide accurate pickup and delivery addresses
  • Only send items that are legal and permitted under our Compliance Policy
  • Ensure packages are properly prepared and labelled for transit
  • Be available (or have someone available) at the pickup location at the agreed time
  • Pay all applicable delivery fees before or at the time of booking
  • Not send items whose declared value exceeds ₦500,000 without prior written agreement

5. Rider Responsibilities

As a Rider, you agree to:

  • Complete deliveries promptly and professionally
  • Handle all packages with care and deliver them in the same condition received
  • Maintain a valid vehicle, licence, and insurance at all times
  • Follow all applicable traffic laws and road safety guidelines
  • Not open, tamper with, or inspect packages beyond what is necessary
  • Report any issues, accidents, or package damage to TikSend immediately
  • Maintain a minimum customer rating as required by the platform

6. Payments and Fees

Delivery fees are calculated based on distance, delivery speed, and package weight. The full fee is displayed before you confirm a booking. By confirming, you agree to pay the displayed amount.

TikSend processes payments through secure third-party payment providers. We do not store card details. Rider payouts are made within 24 hours of a payout request, subject to verification.

Refunds are available in the following circumstances: (a) delivery was not completed due to rider error, (b) package was damaged or lost during transit, or (c) Express delivery was not completed within the guaranteed timeframe. All refund claims must be submitted within 48 hours.

7. Cancellations

You may cancel a delivery request at no charge before a rider has been assigned. Once a rider has accepted the request, a cancellation fee may apply. Cancellation fees are displayed in the app at the time of cancellation.

Repeated cancellations after rider assignment may result in temporary or permanent account restrictions.

8. Liability

TikSend's liability in respect of any loss or damage to a package is limited to the insured value (up to ₦500,000 per delivery) and only where such loss or damage is proven to result from rider negligence or misconduct.

TikSend is not liable for: delays caused by force majeure events (weather, civil unrest, etc.); losses arising from inaccurate sender information; damage to improperly packaged items; or consequential losses of any kind.

To the maximum extent permitted by applicable law, TikSend's total aggregate liability to any user shall not exceed the total fees paid by or to that user in the three months preceding the claim.

9. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Harass, threaten, or abuse other users of the platform
  • Attempt to reverse-engineer, scrape, or interfere with our systems
  • Create fake accounts or impersonate others
  • Circumvent or manipulate the platform's rating or review systems
  • Use the platform to facilitate off-platform transactions to avoid fees

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of Lagos State, Nigeria, unless otherwise agreed in writing.
